Can My Stepfather Cut Me Out of Probate?
Whether or not your stepfather can cut you out of the probate is up for debate. This can be a very tricky question to answer, and one that should be answered by a lawyer experienced in probate law.
Law of Intestacy
Generally, the law of intestacy dictates how an estate is distributed when a parent dies without a will. If the parents are married, half of their estate goes to the surviving spouse and the other half to the children. If a stepchild is alive at the time of the mother’s death, then that child gets a portion of the estate as well.
